Terms & Conditions

1. The service

Telelisting is a customer-relationship and prospecting platform for real-estate professionals, offered as a subscription (SaaS) by Hamel Solutions Internet Inc. ("Hamel Solutions", "we"), 103-2301 Rue St-Patrick, Montréal (Québec) H3K 1B3, Canada. Features vary by plan and may evolve; we may add, change or retire features with reasonable notice for material changes.

2. Accounts & eligibility

You must be of legal age and provide accurate information. You are responsible for your credentials and for all activity under your account. Brokerage accounts may add member seats; the subscriber remains responsible for its members' use.

3. Subscriptions, billing & taxes

• Plans renew automatically each period until cancelled; you can cancel to the end of the current period at any time from your account (no partial-period refunds unless required by law).
• Prices are in Canadian dollars; applicable taxes (e.g. GST/QST) are added. Payments are processed by our payment provider; we don't store full card numbers.
• Failed renewals may lead to suspension after reasonable retry attempts. Some add-ons (e.g. dedicated phone numbers, export credits, per-area-code compliance subscriptions) have their own recurring or consumable pricing shown at purchase.
• Except where the law requires otherwise, fees already paid are non-refundable.

4. Acceptable use & legal compliance

You are responsible for using the platform lawfully in your jurisdiction, including:

• Telemarketing rules (CRTC Unsolicited Telecommunications Rules and the National DNCL). The platform provides compliance tooling, but the legal obligation to respect do-not-call rules rests with you.
• Anti-spam law (CASL) for email and SMS, including consent and unsubscribe handling.
• Privacy laws (Law 25, PIPEDA) for the personal information you store about your own contacts.
• Your professional obligations (e.g. OACIQ rules for Quebec licensees).

Prohibited: illegal content, harassment, attempts to breach security, reselling the service, scraping the platform, or interfering with other tenants.

5. Your content

You own the data you store (contacts, notes, documents, posts). You grant us only the licence needed to host and process it to provide the service. Social posts published through the platform appear under your own social accounts, and you are responsible for their content.

6. Third-party services

Some features rely on third parties (telephony/SMS carriers, email delivery, payment processing, AI providers, social networks). Their availability and rules (e.g. a social network's API policies) are outside our control; a third party changing or revoking access may limit a feature without liability on our part.

7. AI features

AI-generated content (captions, emails, analyses, valuations) is provided as a starting point and may contain errors. Review before use; AI output is not professional, legal or financial advice, and market analyses do not replace a professional appraisal.

8. Availability & support

We aim for high availability but the service is provided "as is" without uptime guarantees; maintenance windows and outages can occur. Support is provided through in-app channels during business hours.

9. Intellectual property

The platform, its software, design, trademarks and documentation belong to Hamel Solutions Internet Inc. and its licensors. Your subscription grants a non-exclusive, non-transferable right to use the service during its term — nothing more.

10. Indemnification

You will indemnify Hamel Solutions against third-party claims arising from your content, your communications sent through the platform, or your breach of these terms or of applicable law (including telemarketing, anti-spam and privacy rules).

11. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim related to the service is limited to the fees you paid in the twelve (12) months preceding the claim, and we are not liable for indirect damages (lost profits, lost data, lost opportunities). Nothing limits liability that cannot be limited under applicable law.

12. Suspension & termination

We may suspend or terminate accounts for material breach of these terms (with notice where practicable). Upon termination you may request an export of your data for up to ninety (90) days, after which it is deleted per our Privacy Policy.

13. Changes to these terms

We may update these terms; material changes will be announced in-app or by email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.

14. Governing law

These terms are governed by the laws of Quebec and the federal laws of Canada applicable therein; the courts of Quebec have exclusive jurisdiction.
